What is Local Import and Export?

Local import and export can be simply understood as a form in which Vietnamese businesses sell goods to foreign partners or customers, but the delivery of goods is conducted within Vietnam as per the foreign customer’s instructions.

According to current regulations, not only domestic companies but also foreign-invested enterprises can engage in this activities.

To carry this out, there are three main points to note:

  • Goods must be sold to a foreign trader.
  • The delivery location within Vietnam is agreed upon by both parties.
  • The consignee information is provided by the foreign customer or trader.

Similarly, local import also follows the instructions of foreign partners, with the purchase contract specifying the delivery location and consignee within Vietnam.

Types of Goods for Local Import-Export

According to Circular 38/2015/TT-BTC, Article 86, the types of goods eligible for local import-export include:

  • Borrowed or rented equipment and machinery, processed products, surplus materials, and scrap from processing contracts, as stipulated in Clause 3, Article 32 of Decree 187/2013/ND-CP.
  • Goods traded between Vietnamese enterprises and foreign partners who are not present in Vietnam, designated for delivery or receipt to a domestic enterprise.
  • Goods exchanged between domestic enterprises and enterprises in export processing zones or non-tariff zones.

 

Customs Procedures for Local Import-Export Goods

Customs procedures for local import-export goods are specifically outlined in various legal documents, including:

  • Decree 08/2015/ND-CP.
  • Circular 38/2015/TT-BTC.

When completing customs documentation, businesses need to prepare the following documents:

  • Customs declaration form.
  • Sales contract.
  • Commercial invoice.
  • Quality inspection certificate (if goods fall under specialized inspection lists).
  • Transport documents.
  • Other relevant documents (if any).

 

Local Import-Export Procedure Process

Businesses must follow five main steps:

  1. Exporter declares customs: The exporting enterprise completes the necessary declarations based on the sales contract with the foreign partner.
  2. Importer completes local import procedures: After declaration is complete, the exporter registers local import procedures at the customs office.
  3. Customs office conducts import procedures: The customs office calculates taxes, confirms the company has completed import procedures, and seals the shipment.
  4. Exporter receives documentation: The exporter receives documentation from customs and forwards it to the customs office where export procedures will be completed.
  5. Customs office conducts export procedures: The customs office receives the declaration and documents, then registers the local import-export declaration.
