Importing Seeds Policy

Currently, the import of crops and seed varieties must comply with the management and control of the Ministry of Agriculture as stipulated in Circular No. 04/2015/TT-BNNPTNT and Decree 187/2013/ND-CP. These documents clearly list the types of crop varieties that are allowed to be grown, traded, and produced in Vietnam. If recognized by the Department of Crop Production, there is no need to apply for an import license. However, some types of seeds imported from abroad must have an import license from the Department of Crop Production.

Current Forms of Seed Import

Nowadays, to meet cultivation demands and harvest yields, many new seed varieties have been developed and improved. Each type of seed has different import forms. Below are two current forms of seed import:

Imports Requiring a License If the seed is not listed in the catalog of crop varieties allowed to be grown and traded in Vietnam by the Ministry of Agriculture, you must have an import license from the Department of Crop Production. New plant varieties need to be strictly controlled to avoid risks to the environment and human health.

Imports Not Requiring a License from the Department of Crop Production If the seed is already listed in the catalog of crop varieties licensed, the import procedures will be much simpler. You only need to prove the quality and origin of the seed batch to import without needing a license from the Department of Agriculture.

Procedures for Importing Seeds

Check the Import Seed Variety: Check if the seed is listed in the catalog of crop varieties allowed for trading and production. If not, you need to apply for an import license from the Department of Crop Production.
Apply for Plant Quarantine Permit: If importing seeds of vegetables and fruits, these seeds must undergo plant quarantine before being imported into Vietnam.
Register and Perform Quarantine at the Border Gate.

Seeds imported into Vietnam are classified under HS code 12099190, belonging to Chapter 12, which includes oil seeds and oleaginous fruits; grains, seeds, and fruits; industrial or medicinal plants; straw and fodder for livestock.

Import Fees

Besides administrative procedures, you need to complete several fees as follows:

Customs fees
Plant quarantine fees
Customs service fees
Storage fees if incurred
Plant quarantine license application fees.

The import customs dossier for seeds needs to include:

Invoice, packing list, sales contract, import declaration
Original phyto certificate
