1. What is CO form VC?
The Certificate of Origin form VC (CO Form VC) is used for goods exported from Vietnam to Chile. This means that goods exported to the Chilean market will enjoy tariff preferences under the Free Trade Agreement between Vietnam and Chile (VCFTA).
In essence, the use of CO Form VC for goods exported from Vietnam applies when the following criteria are met:
- Goods are wholly obtained or produced entirely in Vietnam.
- Goods comply fully with general origin criteria.
- Goods are produced in Vietnam using materials originating from Vietnam or Chile.
Besides these specific regulations, the circular also stipulates the registration process for traders’ dossiers, the CO request process, and the procedures and timelines for issuing CO by authorized organizations under the Ministry of Industry and Trade.
2. Cases for issuing CO Form VC
The Certificate of Origin for goods according to Form VC will be issued in the following cases:
- It will be issued before or at the time of export.
- For certain exceptional cases, it can be issued afterward, but no later than one year from the date the goods were shipped. For these goods, the CO must be marked as “Issued Retroactively.”
- Issuing certified true copies of CO.
- In case the CO Form VC is lost, misplaced, or damaged, the exporter can apply to the CO issuing organization for a certified true copy of the CO. The CO issuing organization will provide a certified true copy of the CO Form VC based on the documents stored at the organization. The certified true copy must be marked as “CERTIFIED TRUE COPY” and will have the same issue date as the original CO.
3. Procedures for Issuing the Certificate of Origin Form VC
The basic procedure for issuing CO Form VC includes the following necessary documents:
- Fully completed application for the Certificate of Origin.
- Fully completed it as per regulations.
- Certified copy of customs declaration (if required for the goods; otherwise, it may not be needed).
- Certified copy of the commercial invoice.
- Bill of lading or equivalent transport documents (certified copy).
- Export goods declaration satisfying preferential or non-preferential origin criteria.
- Declaration of domestic origin of raw materials and production origin, applicable when goods are used in production to create another product.
- Certified copy of the production process of the goods, providing the most detailed information about the production process.
- Other documents, if necessary.
The CO Form VC is valid for 12 months from the date of issuance by the CO issuing organization.
