Entities Permitted to Export Clothing

According to Article 3 of Decree No. 187/2013/ND-CP, the following entities are permitted to export clothing:

Vietnamese traders without direct foreign investment;
Except for goods listed in the export prohibition or temporary suspension categories under this Decree and other legal documents, traders are allowed to export goods regardless of their registered business scope.
Branches of traders are authorized to export and import goods on behalf of the traders.
Foreign-invested enterprises, companies, and branches of foreign companies in Vietnam.

Detailed Procedures for Exporting Clothing

Legal Policies

According to Decree No. 187/2013/ND-CP dated November 20, 2013, clothing is not subject to export prohibition or conditional export. Therefore, companies can proceed with clothing export procedures as ordinary goods under the law.

HS Code and Export Tax Rates for Clothing

Clothing includes various types. To determine the correct HS Code for exported clothing, individuals and units must identify the material, structure, and intended use of the clothing. For clothing items, reference can be made to HS Codes in Chapter 61 and Chapter 62 of the export-import tariff schedule, specifically:

Chapter 61: Articles of apparel and clothing accessories, knitted or crocheted.
Chapter 62: Articles of apparel and clothing accessories, not knitted or crocheted.

Regarding export tax rates, according to the export tariff schedule attached to Circular No. 164/2013/TT-BTC dated November 15, 2013, issued by the Ministry of Finance, items under Section XI of the tariff schedule are not subject to export tax.

Additionally, under current regulations, the VAT on exported goods is 0%. Therefore, when exporting clothing, individuals and units are not required to pay export tax.
