Legal Policy

Wood chips originating from plantation forests are not included in the list of prohibited export goods or those requiring an export license, so they can be exported normally without needing a license. However, when exporting wood chips, attention must be paid to several legal regulations as follows:

Circular No. 01/2012/TT-BNNPTNT: Regulations on legal timber dossiers and verification of timber origin.
Circular No. 40/2015/TT-BNNPTNT: Amending and supplementing Circular No. 01/2012/TT-BNNPTNT on timber dossiers.
Consolidated Document No. 07/VBHN-BNNPTNT: Consolidation on legal timber dossiers and verification of timber.
Circular No. 24/2017/TT-BNNPTNT: Issuing HS Code tables for specialized export and import goods under the management of the Ministry of Agriculture and Rural Development.

HS Code for Wood Chips

Wood chips have two HS code groups: HS 44012100 and HS 44012200. Specifically:

Group 4401: Fuel wood, in logs, billets, twigs, faggots, or similar forms; wood chips; wood waste, sawdust, whether or not agglomerated in logs, briquettes, pellets, or similar forms.
Group 44012100: Wood chips from coniferous trees.
Group 44012200: Wood chips from non-coniferous trees.

Customs Documents for Exporting Wood Chips

The customs documents for exporting wood chips are based on Clause 5, Article 1 of Circular No. 39/2018/TT-BTC, amending Article 16 of Circular No. 38/2015. Specifically, the documents include:

Sales Contract
Commercial Invoice
Timber list with confirmation stamp from the local Forest Protection Department, at the District or Branch level…
Timber list (self-made by the enterprise) according to Form No. 01 attached to Circular No. 01/2012/TT-BNNPTNT.
Export trust contract (if any).

In addition, depending on the import partner’s requirements, the enterprise may need to prepare additional documents such as CO form B, quarantine certificate, and fumigation certificate, etc. The fumigation or plant quarantine procedure is entirely dependent on the importer’s requirements.

Important Notes When Exporting Wood Chips

When exporting wood chips, individuals and enterprises should note:

Vietnam prohibits the export of wood and wood products from domestic natural forests. The commercial export of wood products from Group IA as stipulated by the Government is also prohibited.
Wood and wood products are only allowed to be exported when they have a legal timber dossier as per current regulations. When exporting, traders need to declare information about goods such as quantity and type to the Customs Authority.
According to Circular No. 04/2015/TT-BNNPTNT, enterprises are not required to submit/present timber dossiers when exporting.
