CO FORM S – IMPORTANT NOTES ON CERTIFICATE OF ORIGIN FORM S

If you are involved in the field of import-export or international trade, a Certificate of Origin (CO) is an indispensable document. There are various forms of CO, such as CO form A, CO form D, CO form E, and others. In this article, Smart Link Logistics will help you better understand CO form S and the important considerations related to this form.

1. What is CO Form S?

The Certificate of Origin form S (C/O form S) is a document used for exporting goods from Vietnam to Laos. The effectiveness of C/O form S is closely tied to tariff applications and compliance with the trade agreement between the two countries.

The authority to issue C/O form S is a body authorized by the Ministry of Trade to carry out this process.

2. The significance of CO Form S

Tariff Preferences: C/O form S identifies the origin of goods, determining whether they qualify for tariff preferences under the trade agreement. This ensures that the tariff regime is applied according to the commitments in the trade agreement.

Anti-Dumping and Subsidy Support: When imported goods are sold at dumping prices or subsidized from another country, C/O form S helps determine the origin of these goods. This is crucial for implementing anti-dumping measures effectively and reliably.

Trade Statistics and Quota Management: Identifying the origin of goods through C/O form S facilitates the collection of trade statistics. This supports the maintenance of trade quota management systems and promotes effective trade activities.

3. Procedures for applying for C/O Form S

Prepare the following documents:

  • Completed application form for C/O form S.
  • A fully completed C/O form S in accordance with regulations.
  • Certified copy of the customs declaration after all customs procedures have been completed.
  • Commercial invoice.
  • Bill of lading, airway bill, or a certified copy of equivalent transport documents.
  • Detailed calculation of regional content or a declaration of HS codes for inputs and outputs, or a declaration of pure origin criteria “WO.”
  • Invoices for raw materials, goods, or import customs declarations for materials and parts used in production (if the manufacturer imports materials).
  • Specific production process of the goods.
  • Any other relevant documents that the C/O issuing organization may require to verify the origin of goods, such as import customs declarations for materials, export permits, sales contracts, VAT invoices, and various other documents.

All these documents must be signed electronically by the trader and submitted automatically to the C/O issuing organization. This organization will verify the validity of the dossier. If the dossier is complete and accurate, you will receive a full paper dossier for export use.

4. CO Form S application process

The application process for C/O form S involves the following steps:

Step 1

Register the trader’s profile for the first time on the ecosys.gov.vn system and submit an application for C/O to the C/O issuing organization. Once the account is approved, you can submit the electronic application for C/O or directly submit the paper dossier at the C/O receiving office of the issuing organization.

Step 2

Submit the supporting documents for the C/O form S application to the C/O issuing organization. This can be done online at ecosys.gov.vn, by mail, or by submitting the paper dossier at the headquarters of the C/O issuing organization (where you registered your trader profile).

Step 3

The C/O issuing organization will verify the validity of the dossier. Based on the status of each dossier, the organization will notify the trader with one of the following messages:

  • Acceptance of the C/O and providing a specific time when the trader can collect the C/O.
  • Request for additional documents (if any are missing).
  • Request to verify information in the documents (with a specified text outlining the necessary checks).
  • Refusal to issue the C/O (according to specific regulations in Decree No. 31/2018/NĐ-CP).
  • Request to inspect the trader’s production facility.

Step 4

The C/O officer will recheck the information, input the data into the system, and present it to the authorized person for issuing and signing the C/O.

Step 5

The authorized person from the C/O issuing organization will sign the C/O.

Step 6

After the C/O is issued, the C/O officer will stamp, record it in the register, keep a copy for filing, and issue the remaining copy to the trader.
